Sales and Refunds Terms and Conditions
All Artwork is the Artist’s expression, not work for hire. Artist retains all intellectual and moral property rights inherent in the artwork.
LIVE Artwork is Artwork displayed during the auction. IN STOCK, AVAILABLE, and STUDIO Artwork, MIXED MEDIA, and GICLEE are artwork that may be in stock or to be created.
CUSTOM Artwork is Artwork to be created based on a description to be provided by the purchaser within sixty (60) days after the sale and is limited to one image of one person, one place, or one object. If the purchaser does not give a description within sixty (60) days after the sale, the purchaser authorizes MII to provide an Artwork of the Artist’s choice for the purchaser instead of custom artwork.
Full payment is due immediately unless the Seller and purchaser mutually agree in writing to another date and time. All responsibilities herein of Seller, Artist, MII, and affiliates’ are deemed complete upon delivery of Artwork to the delivery address or upon purchaser’s default of the Terms and Conditions herein.
For all Artwork purchased online without a prior inspection, the purchaser waives inspection and all related rights, and the Artwork is sold As-Is.
All Artwork, content, documentation, processing, and delivery are expressly without warranty or guarantee of any kind; and Seller, Artist, MII, and affiliates shall have no liability and no obligation whatsoever and are not liable for any damages of any kind whatsoever for any use of, or reliance on any information, service or product provided by Seller, Artist, MII or affiliates, except as specifically stated herein. Upon default by the purchaser, the purchaser waives any and all claims and forfeits all Artwork and all payments made, and the purchaser remains liable to pay Seller the full amount due plus any and all collection costs. The seller, Artist, MII, and affiliates shall have no obligation or liability whatsoever to hold artwork for the purchaser beyond ninety (90) days after the Artwork has been offered to the purchaser for pickup or delivery.
The purchaser gives Seller, Artist, MII, and affiliates all rights to use and publish any or all photos of Artwork and or the purchaser photographed together with Artwork, without remuneration.
Auction Checkout is for the purchase of an Artwork described and associated with the winning bidder (“Purchaser”) in the Live Stream Video or event chat to be picked up at 6401 E Rogers Circle, #4, Boca Raton FL 33487 or delivered to an address specified by the purchaser within the continental USA, and is executed and binding upon the purchaser’s winning bid or payment, whichever occurs first. This sale is final, and the purchaser waives all rights to cancel, refuse, alter, or charge back the sale. If Artwork is lost, stolen or damaged before delivery Michael Israel Inc (“MII”) will repair or replace the Artwork at MII’s discretion in lieu of a refund or other compensation to the purchaser.
PROCESSING & DELIVERY
The purchaser will submit a delivery address that is within the continental US to MII within thirty (30) days after the sale. Artwork will undergo the official Michael Israel documentation and forgery prevention process prior to being released for pick up or delivery. All responsibilities herein of Seller, Artist, MII, and affiliates’ are deemed complete upon delivery of Artwork to the delivery address or upon default of the Terms and Conditions herein by the purchaser.
It is agreed that in the event of verified loss or damage prior to delivery, the Artwork will be repaired or replaced at the Artist’s discretion in lieu of refund or compensation for the purchaser.
HOLDING ARTWORK
The seller, Artist, MII, and affiliates shall have no obligation or liability whatsoever to hold artwork for the purchaser more than ninety (90) days after MII has stated the artwork has been released for pick up or delivery.

STUDIO Artwork, MIXED MEDIA, and GICLEE are artwork that may be in stock or to be created based on a displayed image or description. CUSTOM Artwork is Artwork to be created based on a description or reference image(s) to be provided by the purchaser within sixty (60) days after the sale and is limited to one image of one person, one place, or one object. If the purchaser does not give a description or reference image(s) within sixty (60) days after the sale, the purchaser authorizes and requests MII to provide an Artwork of the Artist’s choice for the purchaser instead of custom artwork.
WARRANTEE
Except as described herein, all Artwork, content, documentation, processing, and delivery are expressly without warranty or guarantee of any kind; and Seller, Artist, MII, and affiliates shall have no liability and no obligation whatsoever and are not liable for any damages of any kind whatsoever for any use of, or reliance on any information, service or product provided by Seller, Artist, MII or affiliates.
PAYMENT
Payment in full is immediately due and payable to Seller. All sales are final; the purchaser waives all rights to cancel, refuse, alter, or chargeback the sale. Upon default by the purchaser, the purchaser waives any and all claims and forfeits Artwork and/or payments made, and the purchaser shall remain liable to immediately pay the full amount of this Agreement plus any and all collection costs incurred by the Seller.
IMAGES
The purchaser gives Seller, Artist, MII, and affiliates all rights to use and publish any or all photos or recordings of Artwork and/or purchaser photographed or recorded together with Artwork without remuneration.
